Technical Management Regulations on Road Transport Vehicles


Chapter One: General Rules


Article 1 In order to strengthen the technical management of road transport vehicles, keep the technical conditions of vehicles in good condition, ensure transportation safety, give full play to the efficiency of vehicles, and promote energy conservation and emission reduction, in accordance with the "Safety Production Law of the People's Republic of China", "Energy Conservation Law of the People's Republic of China", "People of China" Laws and administrative regulations such as the Republic’s Road Transport Regulations formulate these regulations.


Article 2 These regulations apply to the technical management of road transport vehicles.


The road transport vehicles mentioned in these regulations include road passenger transport vehicles (hereinafter referred to as passenger cars), road general cargo transport vehicles (hereinafter referred to as trucks), and road dangerous goods transport vehicles (hereinafter referred to as dangerous goods transport vehicles).


The technical management of road transport vehicles mentioned in these regulations refers to the technical management of road transport vehicles in ensuring that they meet the prescribed technical conditions and performing maintenance, repair, and comprehensive performance testing as required.


Article 3 The technical management of road transport vehicles shall adhere to the principles of classified management, prevention first, safety and efficiency, energy conservation and environmental protection.


Article 4 The road transport operator is the main body responsible for the technical management of road transport vehicles. It is responsible for the selection of road transport vehicles, correct use, periodic maintenance, repairs according to the situation, regular inspections and timely updates, and ensure that vehicles put into road transport operations Meet the technical requirements.


Article 5 Encourage road transport operators to use safe, energy-saving, and environmentally friendly vehicles, promote the popularization and application of standardized models, strengthen the application of technology, and continuously improve the management and technical level of vehicles.


Article 6 The Ministry of Transport is in charge of the technical management and supervision of national road transport vehicles.


The transportation department of the local people's government at or above the county level is responsible for the technical management and supervision of road transportation vehicles within its administrative area.


The road transport management agencies at or above the county level implement the technical management and supervision of road transport vehicles.


Chapter Two: Basic Technical Conditions of Vehicles


Article 7 Vehicles engaged in road transport operations shall meet the following technical requirements:


(1) The vehicle's external dimensions, axle load and maximum allowable total mass shall meet the requirements of "Road Vehicle External Dimensions, Axle Load and Mass Limits" (GB 1589);


(2) The technical performance of the vehicle shall meet the requirements of "Comprehensive Performance Requirements and Inspection Methods of Road Transport Vehicles" (GB 18565);


(3) The fuel consumption limit of the vehicle type shall meet the requirements of "Limits and Measurement Methods of Fuel Consumption of Commercial Passenger Cars" (JT 711) and "Limits and Measurement Methods of Fuel Consumption of Commercial Trucks" (JT 719).


(4) The technical level of the vehicle should be at least two. Dangerous goods transport vehicles, international road transport vehicles, passenger vehicles engaged in expressway passenger transport, and passenger vehicles with a length of over 800 kilometers in operation shall have a technical level of level 1. The technical grade evaluation method shall comply with the national requirements for the classification and evaluation of the technical grade of road transport vehicles;


(5) Passenger cars engaged in expressway passenger transportation, chartered passenger transportation, international road passenger transportation, and passenger cars with a length of more than 800 kilometers in operation should reach the intermediate level or above. Its type classification and rating should meet the requirements of the country for the classification and rating of passenger cars in operation;


(6) Dangerous goods transport vehicles shall comply with the requirements of the "Rules for the Transport of Dangerous Goods by Motor Vehicles" (JT 617).


Article 8 The road transport management agency shall strengthen the management of vehicles engaged in road transport operations, and shall not issue road transport permits to vehicles that do not comply with these regulations.


In the issuance of road transport permits and annual inspections to trailers, it should be checked whether the trailer has valid driving certificates.


Article 9 It is forbidden to use scrapped, unauthorized modification, assembling, unqualified vehicles, and other vehicles that do not meet national regulations to engage in road transportation business activities.


Chapter Three: General Requirements for Technical Management


Article 10 Road transport operators shall abide by relevant laws, regulations, standards and norms, earnestly perform the main responsibility of vehicle technology management, establish and improve management systems, and strengthen vehicle technology management.


Article 11: Encourage road transport operators to set up corresponding departments to be responsible for vehicle technical management, and to allocate vehicle technical management personnel according to the number of vehicles and operating categories, and implement effective technical management of vehicles.


Article 12 Road transport operators shall strengthen business training on vehicle maintenance, use, safety and energy conservation, improve the professional quality and skills of employees, and ensure that vehicles are in good technical condition.


Article 13 A road transport operator shall use the vehicle correctly in accordance with the vehicle technical management standards of the relevant road transport enterprise, combined with the technical status and operating conditions of the vehicle.


Encourage road transport operators to formulate technical management standards for vehicle use in accordance with relevant standards and requirements, scientifically set vehicle economic and technical quota indicators and perform regular assessments, and improve vehicle technical management levels.


Article 14 The road transport operator shall establish a vehicle technical file system, and implement one vehicle for one file. The contents of the file should mainly include: basic vehicle information, vehicle technical rating, passenger car type rating or annual type rating review, vehicle maintenance and repair (including "motor vehicle repair and delivery certificate"), vehicle main parts replacement, vehicle Records of changes, mileage, traffic accidents causing damage to the vehicle, etc. The contents of the archives should be accurate and detailed.


When vehicle ownership is transferred or registered, the vehicle technical files shall be handed over with the vehicle.


Road transport operators shall use information technology to do a good job in the management of technical files of road transport vehicles.


Chapter 4   Vehicle Maintenance and Repair


Article 15 Road transport operators shall establish a vehicle maintenance system.


Vehicle maintenance is divided into daily maintenance, primary maintenance and secondary maintenance. Routine maintenance is carried out by the driver, and the first-level maintenance and the second-level maintenance are organized and implemented by the road transport operator, and records should be kept.


Article 16 The road transport operator shall determine the vehicle maintenance cycle by himself in accordance with relevant national standards, vehicle maintenance manuals, operating instructions, etc., in combination with vehicle types, vehicle operating conditions, mileage, road conditions, service life and other factors, to ensure that the vehicles are normal maintain.


The vehicle maintenance operation items shall be determined in accordance with the national technical specifications on vehicle maintenance.


Road transport operators can perform secondary maintenance operations on their own vehicles to ensure that the vehicles put into operation meet the technical management requirements and do not need to conduct secondary maintenance completion quality inspections.


If a road transport operator does not have the ability to perform secondary maintenance operations, it may entrust a motor vehicle maintenance operator above the second category to perform secondary maintenance operations. After completing the second-level maintenance operations, the motor vehicle maintenance operator shall issue the second-level maintenance delivery certificate to the entrusting party.


Article 17 Road transport operators shall follow the principle of repairs based on conditions and repair vehicles in a timely manner based on actual conditions.


Article 18 Special vehicles and special tank vehicles (including tank trailers) used by road transport operators for the transportation of highly toxic chemicals and explosives shall be repaired at an enterprise that has the qualification for repairing road dangerous goods transport vehicles.


The tractors for special vehicles and other vehicles that transport dangerous goods as prescribed in the preceding paragraph may be repaired by enterprises with general vehicle repair qualifications after road transport operators eliminate the hazards of dangerous goods.


Chapter 5   Vehicle Inspection Management


Article 19 Road transport operators shall go to the comprehensive performance testing institutions of motor vehicles regularly to conduct comprehensive performance testing of road transport vehicles.


Article 20 A road transport operator shall, from the month when a road transport vehicle first obtains the "Road Transport Permit", entrust a comprehensive performance testing agency of automobiles to conduct comprehensive performance testing and technical grade assessment in accordance with the following cycle and frequency:


(1) For passenger cars and dangerous goods transport vehicles that have been registered for less than 60 months by the national motor vehicle registration authority for the first time, the inspection and assessment shall be carried out every 12 months; for those exceeding 60 months, the inspection and evaluation shall be carried out every 6 months. Testing and evaluation.


(2) For other transportation vehicles that have been registered by the national motor vehicle registration authority for the first time, inspection and evaluation shall be conducted once every 12 months.


Article 21 The comprehensive performance test of passenger cars and dangerous goods transport vehicles shall be entrusted to the comprehensive performance test agency of the vehicle where the registration is located.


The comprehensive performance testing of trucks can be entrusted to the comprehensive performance testing agency of the vehicle at the transportation station.


Article 22 Road transport operators shall select inspection agencies that have passed the measurement certification of the quality and technical supervision department, obtained the measurement certification certificate, and comply with the "General Requirements for the Capacity of Automobile Comprehensive Performance Testing Stations" (GB 17993) and other relevant national standards for vehicle testing. Comprehensive performance testing.


Article 23 The automobile comprehensive performance testing agency shall compare the vehicles newly entering the road transportation market in accordance with the "Road Transportation Vehicle Fuel Consumption Standard Model Table". New vehicles and vehicles in use shall be tested and evaluated in accordance with "Comprehensive Performance Requirements and Inspection Methods of Road Transport Vehicles" (GB 18565) and "Technical Grade Classification and Evaluation Requirements of Road Transport Vehicles" (JT/T 198). The comprehensive performance test report of road transport vehicles in a unified style across the country is used to assess the technical level of the vehicle and mark it on the report sheet. The road transport management agency at or above the county level where the vehicle registration is located shall indicate the technical level of the vehicle on the Road Transport Certificate.


The automobile comprehensive performance testing agency shall ensure that the testing and evaluation results are objective, fair and accurate, and bear legal responsibility for the testing and evaluation results.


Article 24 The road transportation management agency and the automobile comprehensive performance testing agency entrusted by it to undertake the evaluation of the passenger car type shall perform the classification of the operating passenger car type in accordance with the "Classification and Classification of Operating Passenger Cars" (JT/T 325) or Annual type rating review, and issue a uniform style rating report for passenger car types.


Article 25 Automobile comprehensive performance testing institutions shall establish vehicle testing files, which mainly include: vehicle comprehensive performance testing reports (including basic vehicle information and vehicle technical levels), and passenger car type rating records.


The preservation period of vehicle inspection files shall not be less than two years.


Chapter VI Supervision and Inspection


Article 26 The road transport management agency shall supervise and inspect the technical management of road transport vehicles in accordance with its duties and powers.


Road transport operators shall cooperate with the supervision and inspection of road transport management agencies, truthfully report the situation and provide relevant materials.


Article 27 The road transport management agency shall include the technical status of the vehicle in the annual inspection content of road transport vehicles, and check the following corresponding certification materials:


(1) Evaluation conclusion of vehicle technical grade;


(2) The type and grade evaluation certificate of passenger car.


Article 28 The road transport management agency shall establish a vehicle management file system. The contents of the file mainly include: the basic information of the vehicle, the technical rating of the vehicle, the rating of the passenger car type or the annual type rating review, and the records of vehicle changes.


Article 29 The road transportation management agency shall incorporate the technical management of transportation vehicles into the road transportation enterprise's quality reputation assessment and integrity management system.


Article 30 The road transport management agency shall actively promote the use of modern information technology, and gradually realize the sharing of information resources of road transport vehicle technology management.


Chapter VII Legal Liability


Article 31 If a road transport operator commits one of the following acts in violation of these regulations, the road transport management agency at or above the county level shall order corrections and give a warning; if the circumstances are serious, a fine of 1,000 yuan to 5,000 yuan shall be imposed:


(1) The technical status of road transport vehicles does not meet the "Comprehensive Performance Requirements and Inspection Methods of Road Transport Vehicles" (GB18565);


(2) Using scrapped, unauthorized modification, assembling, unqualified inspection, or other vehicles that do not conform to national regulations to engage in road transportation business activities;


(3) Failure to conduct comprehensive vehicle performance testing and technical grade assessment in accordance with the prescribed period and frequency;


(4) Failure to establish technical files for road transport vehicles or files that do not meet the requirements;


(5) Failure to keep records of vehicle maintenance.


Article 32 If, in violation of these regulations, a road transport vehicle comprehensive performance test agency has one of the following acts, the road transport management agency at or above the county level shall not accept its test report, and copy it to the competent quality and technical supervision department at the same level for handling.


(1) Failing to inspect road transport vehicles in accordance with technical specifications;


(2) The test results of road transport vehicles have not been tested;


(3) Failure to truthfully issue test results.


Article 33 The staff of the road transport management agency who abuses their power, neglects their duties, or practices favoritism during the supervision and management work shall be given administrative sanctions in accordance with the law; if a crime is constituted, the judicial organ shall deal with it in accordance with the law.


Chapter 8 Attached Rules


Article 34 These regulations shall come into force on March 1, 2016. The "Regulations on the Technical Management of Vehicles in the Automobile Transport Industry" (Order of the Ministry of Transportation, 1990 No. 13) and the "Regulations on the Maintenance and Management of Road Transport Vehicles" (Order of the Ministry of Transportation, No. 4, 2001) promulgated by the former Ministry of Transport shall be repealed at the same time.
